PELAKSANAAN DISPENSASI PERKAWINAN DIBAWAH UMUR OLEH PENGADILAN AGAMA TALU PASAMAN BARAT

Abstract

Marriages carried out by minors, the government has provided a policy in determining the minimum age
limit for marriage in Law Number 16 of 2019. Problem Formulation: 1) What is the procedure for
implementing the dispensation for underage marriage in the West Talu Pasaman Religious Court? 2) Was the
judge's consideration in granting the dispensation request at the West Talu Pasaman Religious Court? this
type of research is juridical sociological, data collection techniques with interviews and document studies.
Data were analyzed qualitatively. From the results of the study it can be concluded that 1) marriage
dispensation can be done by submitting an application to the religious court. 2) the judge's consideration
granted the request for dispensation due to urgent reasons.
