KEKUATAN PEMBUKTIAN ALAT BUKTI SURAT DI PERSIDANGAN DALAM MENGUNGKAP TINDAK PIDANA PENCABULAN

Abstract

Article 184 of the Criminal Procedure Code describes the evidence that must be proven in the trial and one of

them is letter evidence. Visum et repertum is a letter of evidence made by a forensic medical expert which is

intended for the judicial process, especially the crime of obscenity with the help of Forensic Medicine.

Objectives: 1) to analyze the strength of proof of documentary evidence in revealing the crime of obscenity. 2)

analyze the judge's consideration of the documentary evidence in applying the crime. This type of normative

juridical research uses secondary data including primary, secondary and tertiary legal materials with qualitative

data analysis. The conclusion is that the documentary evidence in the form of visum et repertum has the power

of proof and becomes the main consideration for the judge in making a decision in this case of the criminal act

of obscenity.
