Abstract

ABSTRAK Copyright infringement is regulated in Law Number 28 of 2014 concerning copyright and is regulated in the TRIPS Agreement that copyright infringement can cause harm to others which is carried out directly by the Word Intellectual Property Organization (WIPO). Based on the above background, the formulation of the problem 1) violates copyright under TRIPS 1994? 2) A juridical analysis of copyright infringement in the PRAYOGA and BRAHMANA cases? Types of normative legal research. Secondary data sources consisting of primary, secondary and tertiary legal materials. The data collection technique is literature study. Data were analyzed qualitatively. Research results 1) Copyright infringement in TRIPS 1994 is lease rights for copyright holders for computer programs and cinematographic works, legal protection for actors, phonogram producers, and broad casting organizations, arrangement of geographical indications, protection of integrated layout designs. 2) Copyright infringement in the case of PRAYOGA and BRAHMANA is taking over the graphic design work and has benefited from the results of the product that has been produced and not paying royalties to the owner of the graphic design work, because it requires the rest of the copyright settlement so that it does not continue.
