ANALISIS YURIDIS PENEMPATAN PEKERJA MIGRAN INDONESIA (PMI) DI MALAYSIA DITINJAU DARI MEMORANDUM of UNDERSTANDING (MoU) 2022

Abstract

ABSTRACK The International Labor Organization (ILO) regulates the protection of migrant workers, but not all countries have ratified it. With so many Indonesian migrant workers in Malaysia, these workers are in a vulnerable situation where they experience harassment, confinement, and violence that ends in death. To minimize this, the governments of Indonesia and Malaysia have agreed to sign an MoU on the protection and placement of Indonesian migrant workers in Malaysia in 2022. The research method used is normative law with secondary data sources consisting of primary, secondary, and tertiary legal materials. Using literature study collection techniques, all of these things are analyzed in a qualitative analysis. The results of the study show that the procedure for placing Indonesian migrant workers is in accordance with what has been agreed through the One Channel System (OCS). The agreed memorandum of understanding was not mandated by either party, so it was re-signed without any exchange or deletion of what had been previously agreed.
