PERTANGGUNGJAWABAN PT KERETA API INDONESIA (PERSERO) DIVRE II SUMATERA BARAT TERHADAP KORBAN KECELAKAAN KERETA API

Abstract

ABSTRAC Trains is a State-Owned Enterprise (SOE) company, contained in the Law of the Republic of Indonesia Number 19 Year 2003. Railway is one of the modes of land transportation, which runs alone or assembled with other vehicles, which moves on rails. Regulations regarding railways are contained in the Law of the Republic of Indonesia Number 23 of 2007 concerning Railways. Problem Formulation 1) How is the responsibility of PT Kereta Api Indonesia for passenger losses due to train accidents in Padang city? 2) How is the settlement of compensation for victims of train accidents in the city of Padang? Type of sociological legal research. The data sources used are primary and secondary data. Data collection techniques are done by interview and document study. The data is analyzed qualitatively. The conclusion of the research results: 1) Railway organizers can not provide responsibility, because the organizers of railway facilities are required to insure their responsibility to PT Jasa Raharja and PT Asuransi Jasa Raharja Putra Putera. 2) By providing compensation to the injured party for the occurrence of a train accident by PT Jasa Raharja, the target of providing compensation to the community is three days from the date of the accident, the victim died at the scene and 1 hour for filing compensation after the file is complete and ready to be submitted.
