MEDIASI PERBANKAN SEBAGAI ALTERNATIF PENYELESAIAN SENGKETA ANTARA BANK DENGAN NASABAH (STUDI KASUS BANK NAGARI CABANG SOLOK)

ABSTRAK A bank is a financial institution that serves storage, credit, and other services for companies, agencies, and government agencies. However, under certain conditions, there will be a dispute between the bank as a service provider and its customers. In resolving this dispute, a legal basis is needed, including Law No. 10 of 1998, Law No. 8 of 1999, Law No. 30 of 1999, Bank Indonesia Regulation No. 7/7/PBI/2005, and Bank Indonesia Regulation No. 8/5/PBI/2006. Based on this legal basis, it is known that dispute resolution between banks and customers can be carried out by litigation (court) and non-litigation channels. The non-litigation path can be taken in one way, namely mediation. With mediation, both customers, as consumers) and banks (as producers) will benefit in terms of time, cost, and simplicity of procedures. The occurrence of an out-of-court agreement benefits the customer as well as banks in saving costs incurred to go through court proceedings such as case costs and advocacy costs.References
