PERLINDUNGAN HUKUM TERHADAP DATA PRIBADI KONSUMEN PENGGUNA E-COMMERCE DI KOTA PADANG

Abstract

ABSTRACT The relationship between consumers and online service providers creates an agreement that binds the rights and obligations between the parties involved. This research aims to find out how legal protection of personal data of e-commerce user consumers in Padang City. Problem Formulation: (1) How is the legal protection of personal data of e-commerce user consumers? (2) How is the legal regulation of the protection of personal data of e-commerce user consumers? This research uses a sociological juridical approach, by conducting interviews with sources, namely Mr. Imam Mutammad as Development Manager of Maxim Office. Primary legal sources used in this research are Law Number 27 of 2022, while secondary legal sources used in this research are books, journals and articles related to this research. The data collection techniques used in this research are interviews and document studies, the results of which will be analyzed systematically. The data is analyzed qualitatively. The results of the research obtained based on this research are that in its implementation the use of online-based services requires protection of the personal data registered, the efforts made by the service provider are to select drivers and provide education related to personal data protection law so that service providers do not misuse personal data from consumers and in the implementation of personal data protection of e-commerce users, cooperation from the government, service providers and consumers themselves is needed so that efforts to protect personal data are more optimal.
