PENYELESAIAN SENGKETA PERBANKAN MELALUI MEDIASI DI BANK RAKYAT INDONESIA CABANG SANGIR SOLOK SELATAN

Abstract

ABSTRAK Mediation can resolve bank and customer disputes. Therefore, Bank Indonesia issued Bank Indonesia Number 10/1/PB1/2008 concerning Amendments to Bank Indonesia Regulation Number 8/5/PBI/2006 concerning Banking Mediation and Bank Indonesia Regulation Number 10/10/PBI/2008 concerning Amendments to Bank Indonesia Regulation Number 7/7//PBI/2005 concerning Settlement of Customer Complaints. Mediation in addition to resolving disputes aims to maintain good relations. Problem Formulation: 1) How is the implementation of banking mediation dispute resolution at Bank Rakyat Indonesia Sangir Solok Selatan Branch? 2) What are the factors causing the occurrence of bad debts of customers at Bank Rakyat Indonesia Sangir Solok Selatan branch. This type of research is juridical sociological, a source of data from primary data and secondary data. Data collection techniques interviews and document studies. The data are analyzed qualitatively. Conclusion of the research results 1) In practice, the settlement of bad debts begins with direct collection by the bank to the debtor, if the settlement is not successful, the BRI Bank Sangir Solok Selatan Branch completes through the mediation channel. 2) The provision of credit from the bank to the debtor, in addition to having to be based on an element of trust, must also be based on the existence of a written credit agreement contract that is bound by legal certainty. At Bank Rakyat Indonesia Sangir Solok Selatan Branch, the causes of bad debts of customers include natural disasters, business competition, uncollectible receivables, customers cannot coordinate money properly.
