PERLINDUNGAN HUKUM TERHADAP PASIEN PENGGUNA BADAN PENYELENGGARA JAMINAN SOSIAL (BPJS) DI RSUD KOTA PARIAMAN

Abstract

ABSTRAK Although the Social Security Administration (BPJS) is a health sector reform project, the truth is that health services are not being used to their fullest extent. For instance, advanced healthcare institutions frequently voice concerns regarding the treatment of BPJS members differently from other patients owing to overbooked treatment rooms. Patients who have completed their responsibilities as members of BPJS Health are gravely harmed by the subpar services offered by BPJS partners. So, the problem formulations that the author uses are 1) How is the form of legal protection for BPJS Health user patients against services at Pariaman City Hospital; 2) What factors affect the slow service of BPJS user patients at Pariaman City Hospital; 3) What efforts are made by the BPJS in regulating the slow health services at Pariaman Hospital. This study uses a juridical sociological methodology, using primary data as the source of information gathered through interviewing techniques and qualitative analysis. The findings indicated that sections in the Consumer Protection Act, the Medical Practice Act, the Health Act, and the Hospital Act all govern the satisfaction of one of the legal conditions for BPJS participants' rights. The results showed that one of the legal rules for the fulfillment of the rights of BPJS participants has been regulated in the Consumer Protection Act, the Medical Practice Act, the Health Act and the Hospital Act. This means that BPJS participants can claim compensation to the hospital as a health provider. The form of responsibility is in the form of aspects of civil law, administrative law and criminal law.
