Peranan Kerapatan Adat Nagari (KAN) Dalam Penyelesaian Sengketa Tanah Ulayat Kaum Di Nagari Cubadak, Kabupaten Tanah Datar

Abstract

ABSTRACT For the Minangkabau people, land is a very important element for every human being. Land uses are very important, always triggering disputes between grandchildren and nephews. This dispute resolution process will have long-term adverse effects if it is not resolved properly. For this reason, it is necessary to have a Nagari Adat Density which has been regulated in West Sumatra Regional Regulation Number 7 of 2018 concerning Nagari so that it can assist in the process of resolving ulayat land disputes. Problem Formulation 1) What is the Role of Density of Adat Nagari (KAN) in Settlement of Ulayat Land Disputes? 2) How is the Customary Land Dispute Resolution Process? 3) What are the Constraints and Efforts of Nagari Traditional Density in Settlement of Ulayat Land Disputes? This study uses a sociological juridical approach using interview techniques in obtaining data, resulting in conclusions 1) The role of Density of Adat Nagari in resolving ulayat land disputes has a major role in reconciling the disputing parties. 2) The process of resolving ulayat land disputes is resolved in 3 (three) stages, namely the clan level, tribal level, and Nagari Adat Density level. 3) The constraints and efforts of the Nagari Adat Density are related to the acceptance of decisions by the disputing parties, therefore strict sanctions are needed to be able to resolve the dispute.
