Abstract

ABSTRACT With the development of technology, buying and selling transaction activities are increasingly advanced. This phenomenon is also accompanied by the growth of E-commerce media and the emergence of various marketplaces, one of which is Shopee in Indonesia. Even though the government and Shopee have guaranteed consumer rights, unfortunately, there are still many sellers at Shopee who do not comply with these rules, so that consumers often feel disadvantaged in the transaction process by Cash On Delivery (COD). The issues to be discussed are: 1) What are the obligations and responsibilities of the seller in the COD online sale and purchase agreement on the Shopee marketplace? 2) What are the rights of consumers in the event of a breach of the COD online sale and purchase agreement on the Shopee marketplace? This study uses a sociological legal approach. Source of data used primary data and secondary data. Data collection techniques were obtained through interviews and literature studies. Data were analyzed qualitatively. Research results: 1) Seller's obligations and responsibilities in COD online sale and purchase agreements in the Shopee marketplace include shipping goods with conditions that match the description, protecting goods during delivery, providing accurate information, fulfilling delivery promises, and handling returns or claims that may arise. 2) Consumer rights which include the ability to file a refund claim, the right to goods according to the description and quality promised, as well as the right to get help from Shopee in serious cases with sellers.
