PERLINDUNGAN TENAGA KERJA WANITA MENURUT INTERNATIONAL LABOUR ORGANIZATION (ILO) NO. 190 DAN IMPLEMENTASINYA DI INDONESIA

Abstract

ABSTRACT The main problem identified in this context is the protection of women workers (TKW), especially those working abroad. The national regulation is contained in Law Number 13 of 2003 concerning Manpower and its international arrangements are in accordance with ILO (International Labor Organization) Convention No. 190. Where there are serious problems that are often faced by TKW, namely violence against TKW in Malaysia, where a TKW experiences torture, burns, and cuts by their employer. The formulation of the problem is 1) How is the protection of migrant workers regulated in the provisions of the International Labor Organization (ILO) No. 190? 2) How is the implementation of the protection of TKW in Indonesia? The research method used is a normative legal approach using secondary data sources, such as primary and secondary legal materials. Data collection was carried out through document study and qualitative data analysis. The results of the study show that the protection of migrant workers working abroad is regulated in ILO regulation No. 190 on violence and harassment in the workplace. Although these ILO provisions have not been ratified by Indonesia, the principles have been applied internationally. However, the implementation of protection for migrant workers in Indonesia has not run optimally, with many migrant workers still experiencing improper treatment.
