Abstract

ABSTRACK Provisions regarding default are contained in article 1238 of the Civil Code which mentions Default is a situation where the debtor is based on a letter the order is declared negligent or based on the deed of a kind or based on the strength of the engagement itself, namely if the specified time has passed in the engagement causes the debtor to have to considered negligent. Formulation of the problem: 1) How is the implementation of BPSK's role in the event of consumer disputes being carried out by business actors? 2) What obstacles did BPSK Padang City face in resolving consumer disputes? 3) What are the efforts made by BPSK in dealing with defaults made by the Yaruki Language institution? The type of research used in this research is socio legal research. The data used includes primary data and secondary data. The data was obtained through interviews and field studies. Conclusions from the research results: 1) the implementation of the role of dispute resolution in BPSK which is prioritized in the dispute resolution process is family deliberations. 2) there are almost no obstacles at BPSK Kota Padang, because the procedural law at BPSK Kota Padang if the plaintiff does not attend twice in a row, the lawsuit will be dismissed or if the defendant is not present then it will be granted. 3) the efforts made by BPSK, namely by mediation in the mediation process if an agreement is reached between the two parties, the case must stop there, BPSK continues to issue a decision and include a peace deed.
