IMPLEMENTASI PERLINDUNGAN HAK PEJALAN KAKI PADA TROTOAR DI KOTA PADANG BERDASARKAN UNDANG-UNDANG NOMOR 22 TAHUN 2009 TENTANG LALU LINTAS DAN ANGKUTAN JALAN

Abstract

In Article 131 of Law Number 22 of 2009 concerning Road Traffic and Transportation which reads: Pedestrians have the right to the availability of supporting facilities in the form of sidewalks, crossing points and other facilities. The formulation of the research problem is: 1) How is the implementation of protecting pedestrian rights on sidewalks in Padang City based on Law Number 22 of 2009 concerning Road Traffic and Transportation? 2) What are the obstacles that arise in the implementation of the protection of pedestrian rights on sidewalks in Padang City based on Law Number 22 of 2009 concerning Road Traffic and Transportation? 3) What efforts have been made by the government of the Padang City to overcome obstacles to the implementation of protecting pedestrian rights in the Padang City? The type of research used is sociological juridical; data sources used are primary data and secondary data; data collection techniques using document studies and interviews; and analyzed qualitatively. The research result: 1) Implementation of the protection of pedestrian rights on sidewalks in Padang City based on Law Number 22 of 2009 concerning Road Traffic and Transportation as a whole has not fulfilled proper sidewalk facilities for pedestrians. 2) Obstacles that arise: a. Lack of people's mindset towards the applicable legal rules b. Misuse of the function of sidewalk facilities c. Lack of outreach to the public about traffic rules. 3) The efforts made by the government of the Padang City to overcome obstacles to the implementation of protecting pedestrian rights on sidewalks in the Padang City based on Law Number 22 of 2009 concerning Road Traffic and Transportation: a. Give a warning to the public b. Controlling street vendors, illegal parking, and those who abuse the sidewalks.
