PENCEMARAN LAUT OLEH KAPAL TANKER MT FREYA DITINJAU DARI UNCLOS 1982 (STUDI KASUS PENCEMARAN DI PERAIRAN LAUT KALIMANTAN)

Abstract

ABSTRACT Marine environmental pollution is when the entry of foreign elements, energy substances or other components into the sea which results in ecosystem changes that cause disruption of the ecosystem and deterioration of environmental quality, so that the ecosystem is not balanced and does not function properly. Problem Statement: (1) How is the regulation of international law of the sea against ship pollution at sea according to UNCLOS 1982, (2) How is the case study of MT Freya's ship polluting in Indonesian seas according to UNCLOS 1982. In this study the author used a type of normative legal research. Secondary data sources consisting of premier, secondary, and tertiary legal materials. Data collection techniques are carried out by means of literature research, data is analyzed qualitatively. Research Results: (1) UNCLOS 1982 has fully regulated the protection and preservation of the marine environment in Chapter XII consisting of 45 Articles (192-237) consisting of several aspects(2) Based on the location of the State of Indonesia is in the position of the cross route of world sea transportation which results in Indonesia having responsibility for waters in accordance with archipelagic states in UNCLOS 1982. The burden of state responsibility in marine pollution carried out by individuals and legal entities is handling prevention, control, pollution mitigation and paying compensation to the parties.
