PENERAPAN PIDANA TERHADAP TINDAK PIDANA PEMBAKARAN HUTAN UNTUK PEMBUKAAN LAHAN (STUDI PUTUSAN NOMOR 228/PID.B/LH/2020/PN.PBU)

Abstract

Burning forests to clear land is a criminal act that can cause environmental pollution as regulated in Article 78 Paragraph (3) jo. Article 50 Paragraph (3) letter d Law of the Republic of Indonesia Number 41 of 1999 concerning Forestry. Similar to the case of forest decision Number 228/Pid.B/LH/2020/PN.PBU. Problem formulation:1) What are the criminal provisions for the crime of forest burning for land clearing in case Number 228/Pid.B/LH/2020/PN.PBU?;2) What are the judge’s considerations in imposing a crime on the crime of clearing forests for land clearing in case Number 228/Pid.B/LH/2020/PN.PBU? Type of normative juridical research, data sources come from secondary data originating from primary, secondary and tertiary legal materials; data collection terchniques with document studies; data analyzed qualitatively. Research results: 1) The minimum penalty applied to perpetratos of the crime of burning forests to clear lan in case Number 228/Pid.B/LH/2020/PN.PBU is 1 (one) year imprisonment and a fine of IDR 50,000,000 ( fifty million rupiah); 2) The judge’s considerations in imposing a sentence on the perpetration of the crime of burning forests to clear land in case Number 228/Pid.B/LH/2020/PN.PBU are considered both juridically and non-juridically.
