Abstract

General elections is a fundamental right for every Indonesian citizen, including individuals with disabilities, as stipulated in Article 5a of aLaw No. a7 of 2017 which regulates equal opportunities for voting, candidacy, and election administration. Nevertheless, practical difficulties have been identified in enabling individuals with disabilities to aexercise their rights in accordance with the aforementioned article. This study addresses the issues pertaining to the implementation of Law No. 7 of 2017a concerning elections, specifically focusing on the rights and opportunities for individuals with disabilities to participate as candidates in elections in Padang City. It examines the challenges encountered by the disabled community, political parties, and the Generala Election aCommission (KPU) ian realizing the poalitical rights of individuals witah disaabilities in elections within Padang City. Additionally, the study investigates the efforts undertaken by the KPU, the disabled community, and political parties in overcoming the obstacles faced by individuals with disabilities in asserting their political rights in Padang City. The research employs an empirical legal methodology with a socio-legal approach, utilizing a mixed-methods design involving qualitative case studies supplemented by quantitative questionnaire surveys. The findings reveal that while the implementation of disabled individualsa voting rights according to Law No. 7 of 2017 has been partially achieved, their rights to stand for election remain unfulfilled. Challenges faced by disabilities who have joined political parties revolve around the lack of direct participation of them in general elections.
