TINJAUAN YURIDIS PEMBEDAAN PERLAKUAN (DISKRIMINASI) KEBUDAYAAN TERHADAP MASYARAKAT KEPULAUAN MENTAWAI DITINJAU DARI PERSPEKTIF UNDANG-UNDANG NOMOR 17 TAHUN 2022 TENTANG PROVINSI SUMATERA BARAT

Abstract

Indonesia is rich in various tribes and cultures, West Sumatra, especially the Mentawai Islands, has unique diversity and deserves to be protected. Law Number 17 of 2022 concerning West Sumatra Province is considered discriminatory for some people in West Sumatra, especially the people of the Mentawai Islands. In article 5 letter C, it only explains that the implementation of the values of the Basandi Syara', Basandi Kitabullah traditional philosophy is in accordance with the prevailing customary rules of Salingka Nagari, as well as the richness of history, language, arts, traditional villages/nagari, rituals, traditional ceremonies and local wisdom. which shows the religious character and high customs of the people of West Sumatra. Problem formulation 1) Differences in cultural treatment of the people of the Mentawai Islands. 2) What are the legal protection efforts? The research method uses normative legal methods (Library research), sources of legal materials 1) primary legal materials. 2) Secondary legal materials, tertiary law. 3) Tertiary legal materials. Techniques for analyzing data, processing qualitative analysis. Research results 1) The perspective of Law Number 17 of 2022 is regulated in Article 5 C in conflict with Article 6 F of Law Number 12 of 2011 concerning the Formation of Legislative Regulations. 2) The legal consequences of the different cultural treatment of the Mentawai Islands Community carry out a Judicial review and Proposed revision of the Law by the DPR.
