ANALISIS TERHADAP PUTUSAN HAKIM NOMOR PERKARA: 508/PDT.P/2022/PN JKT.SEL TENTANG PERKAWINAN BEDA AGAMA

Abstract

ABSTRAK Marriage, as a fusion of souls between male and female individuals, is of particular concern when it is presented in the context of the involvement of different religions, such as the judge's decision case number: 508/PDT.P/2022/PN JKT.SEL regarding marriage between different religions. Problem formulation (1) What is the legal status in the decision of the South Jakarta District Court case number: 508/PDT.P/2022/PN JKT.SEL about interfaith marriage? (2) What is the impact of the South Jakarta District Court's decision case number: 508/PDT.P/2022/PN JKT.SEL on interfaith marriage? The type of research used to obtain the results of this study is a normative approach. The data sources used are primary data, secondary data, and tertiary data. The data collection technique used is a normative legal approach with literature studies, legal materials, and related journals. The conclusions of the research results are (1) Although the Marriage Law does not explicitly provide a prohibition against interfaith marriages, arguments originating from the legal and religious spheres show that marriage annulments related to interfaith marriages and such should be carried out on the basis of the first Precept of the Supreme Godhead and Article 2 Paragraph 1 of the Marriage Law. (2) The impact of interfaith marriages includes hereditary, family, psychological, social and religious dimensions. Children born from such marriages experience uncertainty in their status, as well as a lack of clarity in their status.
