Abstract

ABSTRAK Medical malpractice is an action or negligence by health workers in providing medical services that are not in accordance with professional standards, causing harm or danger to patients. The formulation of the problem is (1) How does the hospital implement its obligations and responsibilities in cases of suspected medical malpractice, (2) What are the obstacles faced by the hospital in implementing its rights and obligations as a health provider, and (3) What are the efforts made by the hospital in implementing rights and obligations as a health provider. The type of research used is sociological juridical. Involving Secondary Data and Primary Data, Data Collection was carried out through interviews, data was analyzed qualitatively. Research results (1) Implementation of Hospital Obligations and Responsibilities, research results show that hospitals carry out their obligations and responsibilities by integrating medical audits, collaboration with expert teams, and improving treatment protocols. The aim is to ensure ethical and legal standards regarding medical malpractice. (2) Hospital obstacles in implementing rights and obligations, complexity of legal aspects, limited resources, and internal communication barriers. Improvements in resource management and departmental coordination are needed. (3) Hospital Efforts in Implementing Rights and Obligations: Efforts include increasing medical staff training, internal supervision, and establishing a multidisciplinary team. Aims to increase understanding of the rights and obligations as a health provider.
