TANGGUNG JAWAB DOKTER TERHADAP KORBAN DUGAAN MALPRAKTIK MEDIK DALAM PERSPEKTIF HUKUM PERDATA DI PUSKESMAS ULAK KARANG KOTA PADANG

Abstract

ABSTRAK A doctor is obliged to carry out his obligations and responsibility for every effort in medical treatment towards patients. Errors or omissions made by doctors when treating patients are known in medical science as Medical Malpractice. The formulation of this research problem is: 1). What is the Form of Responsibility for Medical Malpractice? 2). How is the legal relationship between doctors and patients viewed from a civil law perspective? The type of research used is a sociological juridical research method. Data sources are primary data and secondary data, data collection techniques using literature study, observation and interviews. Data was analyzed qualitatively. Research results 1). The form of a doctor's responsibility for medical malpractice is compensation, which in this case is referring the patient to the hospital and paying for all medical costs while in the hospital. 2). The legal relationship between doctors and patients seen from a civil law perspective is a contractual relationship between the service provider and the service recipient, which takes the form of efforts to heal the patient, which is called a therapeutic agreement.
