PELAKSANAAN MEDIASI SECARA ELEKTRONIK DALAM MENYELESAIKAN SENGKETA PERDATA DI PENGADILAN NEGERI PASAMAN BARAT KELAS II

Abstract

ABSTRACT The Supreme Court provides alternative dispute resolution to the parties by using electronic mediation, as regulated in PERMA No. 3 of 2022 concerning electronic mediation in court. The formulation of this research problem is: 1). How is Electronic Mediation Implemented in Resolving Civil Disputes in the Class II West Pasaman District Court. 2) What are the obstacles in implementing electronic mediation in resolving civil disputes in the Class II West Pasaman District Court. 3). What are the efforts to overcome obstacles in implementing electronic mediation in resolving civil disputes in the Class II West Pasaman District Court. This research uses a type of sociological juridical legal research, data sources are primary data and secondary data, data collection techniques include document study, observation and interviews and then analyzed qualitatively. Research results 1). The West Pasaman District Court has carried out electronic mediation since the promulgation/ratification of PERMA No. 3 of 2022 concerning electronic mediation in court. A total of 5 cases have carried out electronic mediation. 2). The obstacles are the internet network, the parties to the dispute, and the creation of electronic signatures. 3). Efforts have been made to provide internet with a bandwidth of 100 mbps, dedicated 1:1 internet with fiber optic, and provide input on the benefits to the parties so that they can carry out electronic mediation and provide outreach regarding the difficulties in electronic signing.
