Abstract

Social media can be used as a means of campaigning in the Presidential Election (Pilpres) in Indonesia. However, its use still raises various problems. Regulations governing campaigns on social media ARTICLE 37 PKPU No. 15 of 2023. The formulation of the problem in this study 1) How is the juridical review of the use of campaign methods on social media in the Presidential Election in Indonesia? 2) What is the form of prohibition of the Presidential Election Campaign on social media in Indonesia? The research method used is juridical normative is with a statutory approach, legal and conceptual theory. The results of the study are 1) Campaigns on social media are regulated in 2 legal provisions, namely the Election Law and PKPU No. 15 of 2023 The use of social media as a means of campaigning in the Presidential Election in Indonesia has now become common, however, the regulations in the laws and regulations are still not detailed. 2) Forms of Prohibition of Presidential Election campaigns on social media in Indonesia (a) In the Election Law, campaigns are out of schedule, inciting and pitting, committing violence, damaging props, insulting someone, (b) PKPU no. 23 of 2018, is prohibited from being provocative with SARA content (c) Law No. 11 of 2008 concerning Electronic Information and Transactions spreading hostile hatred, but does not specifically regulate the use of social media. Therefore, more comprehensive regulations are needed regarding the use of social media in the presidential election campaign to prevent abuse and maintain the quality of democracy.
