Abstract

The crime of murder is regulated by in Law of the Republic of Indonesia Number 1 of 1946 concerning Criminal Regulations Article 338, and cases involving military members are regulated in Law of the Republic of Indonesia Number 31 of 1997 concerning Military Justice. In early 2023, there was a murder case involving members of the Navy military. Problem formulation: 1 What is thexrole of the Military Police in prosecuting criminal acts of murder committed by military members? 2. What are the inhibiting factors for the Military Police in prosecuting criminal acts of murder committed by military members? The type ofxresearch applied in this research uses empirical legal research using qualitative data analysis in a data collection technique directly in the field interviews. Research results show 1. The role of the military police in resolving cases, starting from the investigation process, receiving reports, searching for evidence, carrying out arrests/seizures, then summoning witnesses to strengthen the evidence, asking for expert information, or other actions of the investigator. 2. Encounter obstacles the investigation process were that the Military Police needed witness statements and looked for evidence, limited facilities, and infrastructure.
