PENERAPAN PIDANA TERHADAP PELAKU TINDAK PIDANA PENCUCIAN UANG DARI HASIL KORUPSI (Studi kasus putusan 62/Pid.Sus-TPK/2022/PN Jkt.Pst)

Abstract

In accordance with Law Number 8 of 2010 which discusses the prevention and eradication of money laundering and Law 20 of 2001 which also discusses the eradication of corruption. Judging from one quite interesting money laundering case that occurred in 2022 yesterday with SD defendants discussed in decision Number 62/Pid.sus-TPK/2022/Pn Jkt.Pst. Researchers in this ruling study formulated the following problems: 1) How is the Judge's Consideration in sentencing Perpetrators of Money Laundering Proceeds of Corruption in Decision Number 62/Pid.sus-TPK/2022/Pn Jkt.Pst and 2) How is the Application of Crime to Criminal Acts Money Laundering in Decision Number 62/Pid.sus-TPK/2022/Pn Jkt.Pst. To answer the above problems, researchers use normative juridical research methods using primary, secondary, tertiary legal material data sources. In collecting data, researchers use document studies and analysis using qualitative descriptive methods. The results of my research are 1) In this case, the judge has two considerations, namely juridical and non-juridical considerations. 2) Based on the defendant's statement and other evidence at trial, the judge concludes that the defendant has committed money laundering with the intention of concealing the property or profits obtained from corruption, as if the property obtained from the corruption crime was considered legitimate and obtained by lawful means.
