KEWENANGAN PARTAI POLITIK DALAM PENGUSULAN TERPIDANA KORUPSI SEBAGAI CALON LEGISLATIF PERIODE 2024-2028

Abstract

Law Number 7 of 2017 concerning General Elections. Elections are held to fulfill the aspirations of the people according to determining candidates to hold important positions in the executive and legislative institutions. Political parties are regional organizations founded by a group of Indonesian people voluntarily based on similar wills and intentions. The formulation of the problem is 1) What is the form of authority of political parties in nominating legislative candidates? 2) How do government regulations and policies regarding nominating corruption convicts as legislative candidates influence political dynamics at the legislative level? The research method is normative, which means the author will analyze primary and secondary legal materials relating to the authority of political parties in nominating corruption convicts as legislative candidates. The results of the research, 1) The form of political party authority is the recruitment of legislative candidates, namely the recruitment of legislative candidates and the selection of legislative candidates. From this authority, political parties must choose legislative candidates who have good integrity. 2) Government regulations and policies regarding whether corruption convicts can nominate themselves are in PKPU No. 10 of 2023 concerning nomination of legislative members.
