PERANAN DITRESKRIMSUS POLDA SUMATERA BARAT DALAM MEMBERIKAN PERLINDUNGAN HUKUM BAGI KORBAN REVENGE PORN

Abstract

The crime of revenge porn is regulated in Law of the Republic of Indonesia Number 19 of 2016 concerning Information and Electronic Transactions Article 27 Paragraph 1 and Law of the Republic of Indonesia Number 12 of 2022 concerning Crimes of Sexual Violence. The criminal act of revenge porn is a special criminal act so that eradicating it is within the authority of one of the cases handled by the West Sumatra Regional Police's Special Criminal and Criminal Investigation Department, namely MPA (24), a UA student, for threatening to spread an immoral video of himself, KA, on social media. Problem formulation: 1) What is the role of the West Sumatra Regional Police in providing legal protection to revenge porn victims?: 2) What are the obstacles encountered by the West Sumatra Regional Police in providing legal protection to revenge porn victims? The type of research is empirical legal research; data sources come from primary data and secondary data; data collection techniques using document studies and interviews; the data was analyzed qualitatively. The results of the research show: 1) The role of the Ditreskrimsus Polda West Sumatra in providing a form of legal protection for victims of revenge porn: 2) The obstacles faced by investigators from the Ditreskrimsus Polda West Sumatra in carrying out the investigation process for revenge porn crimes, namely internal obstacles (loss of evidence, limited tools and equipment and qualifications of law enforcers) and external obstacles (data encryption, lack of disclosure of victims to investigators, and guaranteeing victims' rights).
