PERSEPSI ADVOKAT DI KOTA PADANG DALAM MEMAHAMI BATASAN HAK IMUNITAS SEORANG ADVOKAT PADA SAAT MENJALANKAN TUGAS PROFESI DENGAN ITIKAD BAIK

Abstract

The advocate profession has one privilege (absolute right) in the form of immunity rights, where an advocate cannot be sued civilly or criminally prosecuted in the event of carrying out his professional duties in good faith inside and outside the court. This provision is regulated in Article 16 of Law no. 18 Year 2003 on Advocates. Case example FY, an advocate around 2018 was arrested by KPK investigators, because he was proven to have obstructed investigators from examining his client SN, a suspect in the E-KTP corruption case. Problem Formulation: (1) What are the views of advocates in Padang City in understanding the limits of an advocate's immunity rights when carrying out his professional duties in good faith? (2) How are the efforts of advocate organizations in Padang City to provide an understanding of the limits of an advocate's immunity rights when carrying out his professional duties in good faith? This type of research is juridical sociological, data sources come from primary data and secondary data, data collection techniques with interviews and document studies, data analyzed qualitatively. Research Results (1). There are different perceptions related to the understanding of advocates' immunity rights both from the advocates themselves and from the views of other law enforcement officials. (2) The efforts of advocate organizations in providing an understanding of the immunity rights of advocates are to continue to conduct socialization to law enforcement officials and the public, especially also carried out on prospective advocates during advocate education.
