Abstract

ABSTRAK Human trafficking is a serious crime involving forcing individuals to provide labor, services, or engage in commercial sex acts. This crime not only has an economic impact, but also creates political, cultural, and humanitarian implications, making it one of the five greatest crimes in the world. Poverty, as the dominant factor, makes individuals with low levels of living vulnerable to coercion with the promise of better jobs. Women are especially subjected to frequent human trafficking, compounded by the patriarchal culture that oppresses them. The law is less stringent, providing loopholes for traffickers who are not afraid of legal consequences. The protocol Palermo, while established to address human trafficking, still contradicts the cases that have occurred. In addition, several international conventions have been ratified by the Indonesian government, but their implementation still encounters obstacles. This research uses a normative legal approach, which is carried out by examining library materials or secondary data or often referred to as literature research. The protocol provides for the protection of victims through assistance, status in the receiving country, and repatriation to the country of origin. States are required to prevent and eradicate human trafficking through various efforts such as research, socialization, media campaigns, and social initiatives. Despite regulations, law enforcement and community participation are considered key to uncovering and tackling these crimes. Indonesia, for example, Regency Banyuwangi has issued Regional Regulation No. 1 of 2011 for the protection of women and children victims of violence and human trafficking.
