Abstract

The role of the police is to provide protection, guidance and service to the community. This role is contained in Article 1 point 3 of Perkap no. 8 of 2021 concerning Procedures for Handling Criminal Acts states that Restorative Justice is the resolution of criminal acts by involving the perpetrator, victim, perpetrator's family, victim's family, community leaders, religious leaders, traditional leaders or stakeholders to jointly seek a just resolution through peace with emphasizes restoration back to its original state. For example, on October 26 2022, the Koto Tangah Police carried out restorative justice against the perpetrator who stole the mosque charity box. Problem formulation: 1) What is the role of the Koto Tangah Sector Police in carrying out the restorative justice process in cases of criminal acts of theft? 2) What are the obstacles to the Koto Tangah Sector Police in carrying out the process of restorative justice in cases of criminal acts of theft? Type of sociological juridical research, data sources are primary data and secondary data. Data collection using interviews and document study. Data was analyzed qualitatively. Research Results: 1) The role of the Koto Tangah Police in carrying out the restorative justice process in cases of criminal theft, namely, receiving reports, evidence, examinations, carrying out mediation processes and negotiation processes. 2) The obstacle for the Koto Tangah Police in carrying out the restorative justice process in criminal cases of theft is the internal obstacle of limited human resources for personnel who have mediation or negotiation skills. External obstacles include lack of facilities, lack of public awareness in resolving cases using restorative justice.
