Abstract

ABSTRAK Based on Article 35 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency Number 21 of 2020 concerning Settlement of Land Cases, it states "Cancellation of Legal Products due to administrative defects and/or juridical defects. Land rights disputes can occur due to a lawsuit from a person or legal entity containing legal claims resulting from legal actions that have harmed the plaintiff's land rights. In this research the author formulates the problem, namely: 1) What are the factors that cause double land certificates to occur at the Padang City National Land Agency Office? 2) How is the settlement of maintaining the dual land title certificate at the Padang City National Land Agency Office? This research method is empirical juridical with primary data obtained from interviews and secondary data by processing data originating from primary legal materials and secondary legal materials. The research results show that. 1) The factor that causes double certificates to arise is an administrative error in recording in the Land Owner Taxpayer Register Book about land that is already certified, so that sometimes the sub-district office issues a second Land History Certificate for land that is already certified. 2) Meanwhile, for the settlement of the settlement, the authority possessed by the Padang City Land Office in resolving the double certificate settlement has been implemented or not based on statutory regulations through mediation by selling the land and dividing the proceeds of the sale equally.
