PENGATURAN NON REFOULMENT MENURUT KONVENSI JENEWA TAHUN 1951 DAN IMPLEMENTASINYA DI INDONESIA

Abstract

ABSTRACT The principle of non-refoulement is regulated in the Refugeess Convention of 1951 or also known as the Geneva Convention on the Status of Refugees of 1951, namely in Article 33 of the Geneva Convention of 1951. The formulation of the problem is as follows (1) How is the non-refoulement regulation of the Geneva Convention of 1951 (2 ) How is non-refoulement implemented in the 1951 Geneva Convention and Indonesian statutory regulations? This research was carried out in a normative juridical manner, namely research that is research obtained through research on library materials using primary legal materials and secondary legal materials which include research results, books, scientific journals and other literature. Based on the results of the research, it can be concluded that: 1) The principle of non-refoulement is regulated in the Refugeess Convention of 1951 or also known as the Geneva Convention on the Status of Refugees of 1951, namely in Article 33 of the Geneva Convention of 1951, 2) Regulation and Application of the Principle of Non-Refoulement Refoulement in Indonesia Until now, Indonesia has not become a State Party to the 1951 Convention and the 1961 Protocol concerning the Status of Refugees.
