Abstract

ABSTRACT Credit according to article 1 point 2 of Law Number 10 of 1998 concerning amendments to Law Number 7 of 1992 concerning Banking is the provision of money or bills that can be equated with it, based on an agreement or loan agreement between the bank and another party which requires the party to borrower to pay off his debt after a certain period of time with interest. Problem Formulation: (1) What is the process of implementing a credit agreement at Bank Nagari with land use building rights as collateral whose term ends before maturity? (2) What is the legal protection for creditors if the Building Use Rights period ends before the credit matures? The type of research is sociological juridical research. Data sources are Primary Data and Secondary Data, data collection techniques using interviews and document study, analyzed qualitatively. Conclusions from the research results: 1) bind the Building Use Rights first with a power of attorney by imposing Mortgage Rights as regulated in Article 15 paragraph 4 of the Law on Mortgage Rights. 2) Creditors holding Mortgage Rights whose object is land with Building Use Rights status which ends before the credit matures do not receive legal protection under the UUHT.
