PERANAN RUMAH RESTORATIVE JUSTICE KEJAKSAAN NEGERI PADANG DALAM PENEGAKAN HUKUM TINDAK PIDANA RINGAN

Abstract

Restorative Justice is an approach to justice that focuses on the needs of victims and perpetrators of crimes, and also involves community participation, and does not merely fulfill legal provisions or merely impose criminal penalties. Settlement of cases at the Restorative Justice House is regulated in the Republic of Indonesia Prosecutor's Regulation Number 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice. The case that was resolved was a light criminal case by pursuing a peace settlement. Problem formulation: 1) What is the role of the Padang District Prosecutor's Office of Restorative Justice in law enforcement for minor crimes in Padang City? 2) What are the obstacles faced by the Padang District Prosecutor's Office in enforcing the law for minor crimes in Padang City? The type of research is sociological juridical research. The data source from the author uses primary data and secondary data. Data collection techniques use interview techniques with the Padang District Prosecutor's Office. Research results: 1) The role of the Padang District Prosecutor's Office of Restorative Justice in enforcing the law for minor crimes to resolve cases has been going well and already has the qualifications for problems that can be resolved using Restorative Justice. 2) The obstacles faced by the Padang District Prosecutor's Office are a) Recidivism or the occurrence of repeated criminal acts after the defendant has had his case resolved at the Restorative Justice House. b) Refusal from the victim's family to have the case resolved at the Restorative Justice House.
