TINJAUAN YURIDIS TENTANG KRIMINALISASI TINDAK PIDANA PENGHINAAN TERHADAP MARTABAT PRESIDEN DAN WAKIL PRESIDEN

ABSTRAK The Inodesian Criminal Code of 2023 (KUHP) has a provision on the criminal offense of defamation of the dignity of the president and vice president. The criminalization of this provision has raised pros and cons. It is concerned that this provision could violate the right to freedom of speech. The urgency of this criminalization is because the president and vice president are the personification of the state. In the absence of this regulation, they will be vulnerable to social conflict. The aim is to protect the dignity of the president and vice president as symbols of the state. On the whole, it cannot be proven that this provision is meant to silence the right to freedom of speech because this right has been guaranteed by the constitution. Therefore in a nation of laws as Indonesia there is no such thing as freedom that is as free as possible, everything has its limitationsReferences
