Abstract

The provisions in Article 5 of the Regulation of the Minister of Home Affairs Number 67 of 2017 concerning the appointment and dismissal of Village apparatus or referred to as Wali Nagari in accordance with the procedures stipulated in the article, in this case Wali Nagari Kinari was dismissed not in accordance with the applicable Article. The formulation of the problem in this study: 1). What are the legal consequences of the Padang PTUN decision in the TUN decision Number: 11 / G / 2020 / PTUN.PDG Concerning the dismissal of Wali Nagari Kinari, Bukit Sundi District, Solok Regency? 2). What are the Considerations of the Padang PTUN Judge in the TUN decision Number: 11 / G / 2020 / PTUN.PDG Concerning the dismissal of Wali Nagari, Bukit Sundi District, Solok Regency? This study uses a normative legal research method, data sources consist of Primary Legal materials and Secondary Legal materials, data collection techniques by means of document studies and data are analyzed qualitatively. Research results: 1). Legal Consequences in the Padang PTUN Decision Number: 11/G/2020/PTUN.PDG Regarding the Dismissal of the Village Head of Bukit Sundi District, Solok Regency: a. Declaring the Decision of the Solok Regent regarding the Dismissal of the Kinari Village Head to be void, b. Returning the position and rights of the Kinari Village Head, c. Compensation and rehabilitation. 2). Considerations of the Padang PTUN Judge in the TUN Decision Number: 11/G/2020/PTUN.PDG Regarding the Dismissal of the Bukit Sundi District Village Head, Solok Regency, namely: Granting the Plaintiff's Claims in their entirety and Rejecting the Defendant's Exception.
