PENEGAKAN HUKUM TERHADAP TINDAK PIDANA PENGANIAYAAN YANG DILAKUKAN OLEH ANAK TERHADAP ORANG TUA (STUDI KASUS DI KEPOLISIAN RESOR KOTA PADANG PANJANG)

Abstract

Law enforcement against criminal acts of abuse committed by children against parents is regulated in Law Number 1 of 1946 concerning Criminal Law Regulations (KUHP 1946) and Law Number 23 of 2004 concerning the Elimination of Domestic Violence (UU PKDRT). The study aims to analyze: 1) The law enforcement efforts against criminal acts of child abuse toward parents at the Padang Panjang Police; 2) The challenges faced by the police in the process of enforcing the law on such cases. This research employs an empirical juridical approach, gathering primary data through interviews and secondary data from document studies. The data analysis technique is descriptive qualitative. The findings reveal that law enforcement efforts include penal and non-penal approaches, while challenges faced include internal factors (lack of facilities, insufficient human resources, high workload, and lack of coordination) and external factors (lack of witness and victim testimony, lack of public awareness, and technological developments).
