PERLINDUNGAN HAM TERHADAP SUKU ANAK DALAM SEBAGAI KAUM INDIGENOUS DI PROVINSI JAMBI DI TINJAU DARI KONVENSI ILO 169 TAHUN 1989

Abstract

ABSTRACT The Anak Dalam tribe as an indigenous people is one of the alienated and minority tribes living in Batang Hari, Bungo, Sarolangun and Merangin districts in Jambi Province who have currently experienced evictions and land grabbing by the Government and plantation companies, this is a violation of human rights regulated in the UDHR. Meanwhile, the provisions regarding indigenous peoples as indigenous people are regulated in ILO Convention no. 169 of 1989. Problem Formulation: (1) How is human rights protection for Suku Anak Dalam as indigenous people according to ILO Convention 169? (2) How are efforts to protect the human rights of Suku Anak Dalam according to indigenous peoples in Jambi Province? Type of research Sociological Law. Data sources used primary data and secondary data. Data collection techniques carried out document studies and interviews. Data is analyzed qualitatively. Conclusion of research results: 1. Human rights protection of the Anak Dalam Tribe as Indigenous people according to ILO Convention 169 stipulated in Article 14 which means it forces the state to recognize the control and ownership rights of indigenous peoples. If not recognized, the state will violate the rights of these indigenous peoples. For this reason, the government government of jambi provincemust protect the Anak Dalam Tribe as indigenous people. 2. Efforts to protect the human rights of Suku Anak Dalam in Jambi Province carried out by the Merangin Regency Government and in collaboration with PT Sari Aditya Loka have carried out guidance in the form of settlements, smart homes, empowerment and health, as well as monthly basic food assistance, formal and non-fomal education which is included with free lunch. However, there are still Suku Anak Dalam who isolate themselves because they have not received updates related to the eviction and change of forest function.
