Abstract

ABSTRACT As an implementation of UUPK article 53, and the government issued Decree of the Minister of Industry and Trade Number 350/MPP/Kep/12/2001 regarding the Implementation of Duties and Authorities of the Consumer Dispute Resolution Agency. This institution is the operational basis that regulates in detail the mechanism for resolving consumer disputes at BPSK, including mediation procedures. BPSK is present as an institution that is given special authority to resolve among business actors and consumers. Problem: a) How is the application of both parties by the mediation at the Padang City Consumers Dispute Resolution Agency? B) What are the factors that influence the success of mediation by deciding the consumer disproves at the Padang City Consumers Dispute Resolution Agency? This method type is sociological-juridical. The data came frome primary and secondary data. The analysis of data is qualitative method. Result: 1) The implementation of consumer dispute resolution through mediation at BPSK Padang City for the 2022-2024 period showed that all cases were successfully resolved but there were obstacles in the mediation process. 2) Indicators which support the mediation’s success include the competence of the mediator, the cooperative attitude of the parties, the quality of communication, clarity of procedures, and institutional legal support. However, the mediation process faces obstacles such as lack of good faith from the parties, more than one summons, and indiscipline from the parties.
