PERLINDUNGAN HUKUM TERHADAP PENGEMUDI ANGKUTAN SEWA KHUSUS BERBASIS APLIKASI GOJEK DALAM HUBUNGAN KEMITRAAN DENGAN PT GOJEK DI KOTA PADANG

Abstract

ABSTRACT The development of digital technology has affected various sectors, including transportation. The introduction of the Gojek application has transformed transportation patterns, where drivers of app-based rental services have become an integral part of the system. The partnership between drivers and PT Gojek often creates an imbalance between rights and obligations. The research questions are: 1) How is the legal protection for app-based transportation drivers in Padang City? 2) What obstacles are faced in providing legal protection to app-based transportation drivers in Padang City? 3) How efforts has Gojek made to address these obstacles in legal protection for app-based transportation drivers in Padang City? This study is sociological juridical. The sources are primary and secondary data. Data collection techniques were interviews and literature study. The data analysis used is qualitative analysis. The results are: 1) Legal protection for Gojek drivers in Padang City includes workplace safety protection, performance-based wage systems, security protection through the emergency button feature, driver personal data protection, and legal assistance. 2) Obstacles in legal protection include lack of driver education, bad ratings, and fictitious orders. 3) Gojek’s efforts to address challenges include conducting driver training programs, implementing transparent rating system, and developing systems to detect fictitious orders.
