Abstract

ABSTRACT Sale and purchase agreements have an important role in ensuring legal certainty and business relationships, including the oil palm plantation sector. The implementation of the oil palm fresh fruit bunches (FFB) sale and purchase agreement between Supplier UD. AAN and PT Sawita Pasaman Jaya (SPJ) in West Pasaman is the subject of this study.The formulation of the problem includes 1) How is the implementation of the sale and purchase agreement of oil palm fresh fruit bunches between UD. AAN and PT Sawita Pasaman Jaya in West Pasaman? 2) What are the problems that occur in the sale and purchase agreement of oil palm fresh fruit bunches between UD. AAN with PT Sawita Pasaman Jaya in West Pasaman? 3) How is the settlement if there is default in the implementation of the sale and purchase agreement of oil palm fresh fruit bunches between UD. AAN with PT Sawita Pasaman Jaya in West Pasaman? This research uses sociological juridical methods, with primary and secondary data obtained through document studies and interviews. The data analysis used is qualitative. Research results: 1) The implementation of the agreement is carried out through a systematic process starting from the submission of applications and surveys to assess the quality of FFB. 2) There are obstacles such as discrepancies in FFB quality, and delays in delivery. 3) To overcome defaults, the SPK stipulates a settlement mechanism through consensus as the main priority, and sanctions for continuing violations and litigation as the last option.
