EVALUASI EFEKTIVITAS PENERAPAN RESTORATIVE JUSTICE OLEH SATLANTAS POLRESTA PADANG DALAM PENANGANAN KASUS KECELAKAAN LALU LINTAS

Abstract

The implementation of Restorative Justice is regulated under Indonesian National Police Regulation Number 8 of 2021, which governs the handling of criminal offenses based on restorative justice principles. This study was conducted in response to a traffic accident in the GOR Agus Salim area, Padang, involving a bus and a pedestrian. This research aims to assess the effectiveness of Restorative Justice applied by Polresta Padang in resolving traffic accident cases and to identify the challenges encountered in its implementation. Employing a socio-legal (sociological juridical) approach, primary data were collected through interviews with IPTU Zulkifli, AIPTU Iswandi, and AIPDA Arianto, while secondary data were obtained from legislation and literature, including traffic accident records from Polresta Padang between 2022 and 2024. Data collection methods included interviews and document analysis, and the findings were analyzed using a qualitative approach. The results indicate that the Restorative Justice approach implemented by Polresta Padang in traffic accident resolution has been effective, with the majority of cases being successfully settled through this mechanism rather than through alternative legal procedures. However, several challenges remain, including victim trauma, low offender awareness, and limited resources, which hinder the full implementation of Restorative Justice in traffic accident resolution.
