IMPLEMTASI SENGKETA KONSUMEN MELALUI BADAN PENYELESAIN SENGKETA KONSUMEN (BPSK) DIWILAYAH KOTA PARIAMAN

Abstract

ABSTRACT The implementation of consumer disputes through the Consumer Dispute Settlement Agency (BPSK) as regulated in Law Number 8 of 1999 concerning Consumer Protection. The issues addressed in this study are: 1) How does the Consumer Dispute Settlement Agency (BPSK) of Pariaman City handle consumer disputes in the Pariaman City area? 2) What are the obstacles faced by the Consumer Dispute Settlement Agency (BPSK) of Pariaman City in resolving consumer disputes in the Pariaman City area? 3) What efforts are made by the Consumer Dispute Settlement Agency (BPSK) of Pariaman City in resolving consumer disputes in the Pariaman City area? This research uses a sociological legal approach with primary data collected through interviews with the Consumer Dispute Settlement Agency (BPSK) of Pariaman City, and secondary data in the form of statistical data on the number of consumer dispute resolution cases in Pariaman City. The results of this study indicate that BPSK has the authority to resolve disputes between consumers and business actors through mediation, negotiation, and, if necessary, binding decisions. The study shows that although BPSK provides quick and low-cost solutions for consumers, there are several challenges, such as the lack of socialization about the functions of BPSK. Therefore, efforts to improve BPSK's capacity and raise public awareness are needed to make BPSK more effective in carrying out its functions.
