PERANAN KERAPATAN ADAT NAGARI (KAN) DALAM PENYELESAIAN KONFLIK TANAH ULAYAT DI NAGARI KOTO BARU KECAMATAN SUNGAI PAGU KABUPATEN SOLOK SELATAN

Abstract

The Role of Density of Adat Nagari in Resolving Ulayat Land Conflicts in Nagari Koto Baru Even though it has customary authority to resolve disputes, the disagreement of the disagreements of the disputing parties causes the settlement to continue to the Solok City District Court. The formulation of the research problem is 1). What is the role of KAN in in Settlement of Ulayat Land Disputes in Nagari Koto Baru, Sungai Pagu District, South Solok Regency? 2). What are the constraints by KAN and the conflicting community in resolving Ulayat Land conflicts in Nagari Koto Baru, Sungai Pagu District, South Solok Regency? 3). What are the efforts made by KAN in resolving Ulayat Land conflicts in Nagari Koto Baru, Sungai Pagu District, South Solok Regency? The type of research is sociological juridical. Data sources include primary and secondary data. The data was analyzed qualitatively. Conclusion 1). The role of KAN in resolving Ulayat Land conflicts, provides a medium for discussion, if the parties to the dispute want legal certainty, they are given a letter of recommendation to the District Court. 2). The constraints by KAN are, the community directly submits problems to the court, low community compliance, limited legal authority, lack of competent resources in the legal field, verbal disputes between parties, and lack of coordination between traditional leaders. Claimants face lengthy procedural constraints, high costs, and a lack of understanding of customary law. 3). The efforts made by KAN are simplifying the dispute process, strengthening the mediation system, maintaining independence, increasing transparency, and holding educational forums.
