PERANAN KEPOLISIAN RESOR KOTA BUKITTINGGI DALAM MENANGGULANGI TINDAK PIDANA KEKERASAN SEKSUAL SESAMA JENIS YANG TERJADI DI LINGKUNGAN PESANTREN

Abstract

The crime of same-sex violence is a case that often occurs in the Islamic boarding school. The Crime of Same-Sex Sexual Violence is regulated in the Law of the Republic of Indonesia Number 12 of 2022 concerning the Crime of Sexual Violence. In the last 4 years, Bukittinggi Police has solved 14 cases of samesex sexual violence that occurred in the pesantren environment, and the cases were submitted to the attorney general's office. Problem formulation: (1) What is the role of the Bukittinggi Police to overcome the Crime of Same-Sex Sexual Violence that occurred in the islamic boarding school? (2) What obstacles are encountered by the Bukittinggi Police in tackling the Crime of Same-Sex Sexual Violence that occurred in the islamic boarding school? This type of research is sosio legal research, data sources consist of primary data and secondary data obtained from document studies and interviews, analyzing the data with qualitative analysis. The results of the research are as follows: (1) The Role of Bukittinggi Polresta in Overcoming Criminal Acts of Same-Sex Sexual Violence that Occurred in the islamic boarding school, namely by making Non Penal Efforts and Penal Efforts. (2) The obstacles encountered by the Bukittinggi Police in Overcoming the Crime of Same-Sex Sexual Violence that Occurs in the islamic boarding school in the form of internal factors which include lack of synergy, lack of human resources, limited facilities and technology, budget limitations, while external factors include difficulty finding evidence, victim knowledge, lack of witnesses and evidence, lack of supervision from the pesantren. ______________________________________________
