ABSTRACT Sea Freight Forwarding (EMKL) plays a crucial role in the distribution of goods between islands in Indonesia. However, in practice, challenges such as damage to goods during transportation often occur, which can harm consumers. This study aims to analyze the legal protection for consumers against damage to goods during transportation, identify the challenges faced, and understand the resolution measures taken by EMKL. The research problems are: 1) What is the liability for damage to goods during transportation by PT. Anugerah Prada Jaya Logistik as an EMKL? 2) What are the challenges in consumer legal protection against damage to goods during transportation by PT. Anugerah Prada Jaya Logistik as an EMKL? 3) What resolution efforts are undertaken by PT. Anugerah Prada Jaya Logistik as an EMKL in handling cases of damaged goods? This study employs a sociological juridical research method, using normative and empirical approaches through document studies and interviews. The findings indicate that PT. Anugerah Prada Jaya Logistik implements both preventive and repressive legal protection. Preventive protection is carried out through strict operational standards, shipment documentation, and compliance with existing regulations, while repressive protection is provided through compensation mechanisms, both non-litigation (negotiation and mediation) and litigation (civil lawsuits). The main challenges faced by the company in the compensation process include payment delays, extreme weather conditions, and operational difficulties such as accidents in land transportation.References
