Abstract

ABSTRACT The families of ODGJ patients who participate in BPJS Health Insurance feel that they are differentiated from mental hospitals in health services. Article 28 Paragraph (3) of the 1945 Constitution and Law Number 17 of 2023 concerning Health states that everyone has the right to receive health care in accordance with health service standards. Problem Formulation: 1) What is the form of legal protection for ODGJ patients who participate in BPJS Health insurance services at the Mental Hospital Prof. HB. Saanin Padang? 2) What are the obstacles in health services for ODGJ patients who participate in BPJS Health insurance services at the Mental Hospital Prof. HB. Saanin Padang? 3) What are the efforts made for ODGJ patients who participate in BPJS Health insurance services at the Mental Hospital Prof. HB. Saanin Padang?. Types of sociological juridical research, primary data sources and secondary data. Interview data collection techniques and document studies. Data is analyzed qualitatively. Research Results 1) Legal protection for ODGJ patients who participate in BPJS Health Insurance is carried out in a preventive, repressive, promotional, curative and rehabilitative manner 2) The obstacles faced are the difference in perspective between the hospital and BPJS Health Insurance and between the hospital and the patient's family, the existence of pending claims, lack of public understanding of their rights and obligations as BPJS Health Insurance participants 3) The efforts made are, having fulfilled the completeness of the ODGJ Service Policy and SOP of both Promotional, Preventive, Curative and Rehabilitative.
