Abstract

ABSTRACT Shipping/expedition services play an important role in supporting the mobility of goods, both within the country and between countries. With advances in technology and the development of e-commerce, expedition services are experiencing innovation to meet the needs of consumers who increasingly demand speed and accuracy of delivery. The use of goods delivery/expedition services has become a necessity for the community in carrying out online buying and selling activities and sending goods. One delivery service company that has delivery coverage throughout Indonesia is PT. J&T Dharmasraya branch. However, there are several problems in delivery such as damage and loss of goods, which is detrimental to consumers. Therefore, the delivery service is responsible for damage and loss of the goods. The issues that will be discussed are 1) What is the legal responsibility of the expedition company for the loss and damage of goods? 2) What efforts does the expedition company make to prevent loss and damage to goods? This research uses a sociological legal approach. The data sources used are primary data and secondary data. Data collection techniques were obtained through interviews and literature study, the data analysis used was qualitative. Conclusion of the investigation: 1) The shipping company seeks to provide compensation for lost/ damaged goods in accordance with the applicable laws and regulation in the civil code (KUHP), commercial code (KUHD) and article 19 of law number 8 of 1999 concerning consumption protection. 2) PT. J&T Express Dharmasraya branch seeks to provide compensation for lost/damaged goods in Dharmasraya, whether using insurance or not using insurance according to the applicable J&T Express standard operating procedures (SOP).
