PERLINDUNGAN HUKUM BAGI TERTANGGUNG DALAM PERJANJIAN ASURANSI KENDARAAN BERMOTOR PADA PT. ASURANSI ASTRA BUANA (GARDA OTO) CABANG PADANG

Abstract

ABSTRAK Motor Vehicle Insurance is a form of insurance that provides guarantees for damage or loss to vehicles according to the Indonesian Motor Vehicle Insurance Standard Policy with Comprehensive (Combined) and total loss coverage, which can be extended to third party legal liability, driver and passenger accidents. Problem Formulation: 1) How is the Legal Protection for the Insured in the Motor Vehicle Insurance Agreement of PT. Asuransi ASTRA Buana (Garda Oto) Padang Branch? 2) How is the Responsibility of the Insurance Company as the Guarantor in the Motor Vehicle Insurance Agreement of PT Asuransi ASTRA Buana (Garda Oto) Padang Branch? This type of research is sociological juridical. Data collection techniques were obtained through interviews and document studies. The results of the study are 1) The Form of Legal Protection provided is contained in the insured's Policy which has been stamped with an electronic stamp and if a dispute occurs it can be resolved at the Alternative Dispute Resolution Institution (LAPS) 2) Form of Responsibility from PT. ASTRA Buana Insurance (Garda Oto) Padang Branch, namely Partial Compensation and Total Compensation depending on the insurance policy taken and payment of compensation is made no later than 30 days by the Insurer.
