KAJIAN YURIDIS PUTUSAN PENGADILAN TATA USAHA NEGARA PADANG NOMOR 2/G/2022/PTUN.PDG TENTANG PENOLAKAN PERMOHONAN PEMECAHAN SERTIFIKAT TANAH KAUM KELURAHAN LIMAU MANIS KECAMATAN PAUH KOTA PADANG

Abstract

Clan land is part of the customary law system that is inherited from generation to generation and managed communally. However, in practice, clan land often experiences legal problems, especially in the land administration process. One of the problems that arises is the refusal to split the clan land certificate by the Padang City Land Office, as happened in the State Administrative Court Decision (PTUN) Number 2/G/2022/PTUN.PDG Regarding the Refusal to Split the Clan Land Certificate in Limau Manis Village, Pauh District, Padang City. Problem Formulation: 1) Legal consequences if the State Administrative Officer does not carry out the execution of the PTUN Decision. 2) Consideration of the Padang Administrative Court Judge in Administrative Court Decision Number 2/G/2022/PTUN.PDG. The research method used is normative juridical with a statutory approach and case studies. The data sources used include primary and secondary legal materials which are analyzed qualitatively. The results showed that the Padang Administrative Court canceled the decision of the Padang City Land Office which rejected the splitting of the people's land certificate and obliged the defendant to revoke the decision and continue the certificate splitting process.
